WAMPSVILLE — a nine-man, three woman jury found 51-year-old Chauncey “Champ” Winchell guilty of first-degree murder and nine other lesser charges in the murder of mark Murray.after deliberating for more than two hours, the jury returned the verdict on all counts possible. As the jury foreman read guilty verdicts on each count, Winchell looked back at several sobbing family members seated in the courtroom. he stared as each juror was tediously polled on each of the 10 charges.From the last row in the courtroom, his son, Champ Winchell yelled “I love you Dad,” as he was handcuffed. His son later stormed out of the courtroom, pushing his way past other family members and jumping over a row of seats.Winchell was ordered to be held in Madison County Jail without bail until he is sentenced May 1. While Judge Dennis McDermott denied defense attorney Neal Rose’s request to overturn the jury’s verdict because, according to Rose, not enough time was spent reviewing the evidence during deliberation, Assistant District Attorney Bob Mascari was hesitant to call the case a victory.While he said it was “painfully obvious” that Winchell was “painfully guilty,” there’s “nothing that we can do to bring the victim back.”“The answer, the jury saw immediately,” he said. “I’m happy justice was done.” The verdict should give Murray’s family some closure, but “we don’t get justice in this world,” he said.he credited the multiple police agencies, particularly the Syracuse and Oneida police departments, and his colleagues in the district attorney’s office for their hard work in bringing the extensive case together.Mascari will seek the maximum sentence possible in the case — life without possibility of parole.“He’s right where he should be,” he said.Besides first-degree murder, Winchell was also found guilty of two counts of first-degree robbery, one count of second-degree robbery, first-degree criminal use of a firearm, two counts of second-degree criminal possession of a weapon, first-degree unauthorized use of a motor vehicle, third-degree criminal possession of a weapon and fourth-degree criminal possession of stolen property.In closing arguments earlier in the day, Mascari asked the jury in a bellowing voice, “If it wasn’t Chauncey Winchell, then who was it?” it was that repeated statement that Rose objected to, motioning for a mistrial.Arguing that the prosecution’s statement implied to the jury that the defense has a burden to proof, Rose moved that McDermott declare a mistrial. Mascari called that request “silly” and the judge denied Rose’s motion.Just minutes prior, Rose had made an objection to Mascari’s final remarks in the prosecution’s closing arguments. Separated by only a table, Mascari stood, looked Winchell in the eye, pointed directly at him and said “You’re a murder, a robber and a thief.”“You are guilty as charged,” Mascari’s voice boomed before Rose diffused the tension with an objection.Mascari outlined the “overwhelming proof” the prosecution had presented the 12-member jury during the past two and a half weeks, saying that no other explanation fit the facts other than the belief that Winchell robbed and murdered 41-year-old mark Murray May 22, 2008.In a desolate spot in an unused field, Murray was murdered and buried in an unmarked shallow grave with “no one to mourn in his passing, no one to say words of condolences to his family,” Mascari said.While no cell phone, wallet, identification, money, pants or shoes were found with Murray’s remains on Canal Road in Oneida in 2010, Mascari said Winchell is responsible for his death. using two .22 caliber bullets, Mascari said examination of Murray’s remains prove that he was shot “execution style” with visual bullet entry wounds near the bottom of his ears and the absence of exit wounds. Absent from what police discovered on Canal Road was the $10,000 in cash that Murray supposedly had on him, his car and the $5,000 he is said to have had in his trunk.The defense has argued that Murray’s car was never stolen, but was instead purchased by Winchell. Mascari substantiated the prosecution’s assertion that multiple people saw Murray with his prized Firebird the day before he was allegedly murdered and his mother reported him last seen with the car before he disappeared May 22.no evidence exists to prove the defense’s theory that the car was sold to Winchell. Murray had no intention of selling the car and had even turned down an offer to buy the car that was nearly double what he paid for it May 13.While Rose said neither Winchell nor Murray were the “type” of people to be “wed to formality,” he said it was unlikely that either cared about completing the proper paperwork for the sale. Mascari said Murray had indeed filed for the title when he purchased it. if it was true Winchell purchased it, he never inquired about the title or made any attempt to follow up with Murray for its transfer.“Because you don’t bother calling dead people,” Mascari said. The fact that Winchell had possession of the car, a point Rose has not disputed, proves that Winchell had contact with Murray May 22, something that Rose has argued.“They had to be together,” he said.Rose disputed the prosecution’s assertion that Murray was murdered May 22, saying that the medical examiner could not testify as to any potential timeframe in which he would have died. other explanations can account for the circumstantial claims the prosecution has made about both Winchell and Murray’s whereabouts that day.Mascari said there is “no other reasonable interpretation of the evidence” than that Murray was killed on May 22. Phone records show the last call ever received by Murray was at 3:36 p.m. that day.after that his phone was shut off. There was also no activity in his bank account that still contained thousands of dollars nor did anyone see him again after his supposed interaction with Winchell in Oneida.Both sides also offered conflicting summations of the time frame in which Winchell would have killed Murray. Rose said only a narrow 15 minute window would have been available for him to kill and bury Murray, according to his interpretation of the testimony presented in the trial. Mascari disagreed however, saying it happened within an hour to an hour and a half.Mascari also pointed to Winchell’s actions after the murder to further substantiate the crimes he has been charged with. Acting nervous, paranoid and out-of-character, Mascari said Winchell showed up at his brother and sister’s home on Middle Road in Oneida with the Firebird, took several trips down a trail into a swampy wooded area with bags only to return empty handed, showed his sister a gun and told his brother than he earned $10,000 for a job he recently worked. he also showed a gun to someone in Tennessee, where he traveled with the Firebird after the murder.he later sold the car to a mechanic, who, because Winchell refused to show ID and did not have its title, wrote off the sale as an unpaid service in order to take ownership of the car. Rose had a different theory, saying the transmission needed to be replaced and unwilling to spend the amount of money to fix it, Winchell abandoned the car at the garage.Mascari reviewed the testimony of several unrelated witnesses who told the jury that Winchell had told them of his plans to rob a drug dealer and even attempted to recruit others to help him. a drug dealer was his target because one was unlikely call the police to report the robbery.One witness in particular made a report with the New York State Police in January 2008 after Winchell told him he was going to rob a drug dealer of his money and drugs, shoot him in the head, dump his body, steal his car and move to Tennessee – a sequence of events with startling similarity to the way Murray was murdered.According to Rose, the police investigated that report and found no evidence to substantiate it.“Talking is one thing, doing is something else,” Rose said. Telling people that he was going to rip off a drug dealer doesn’t mean he ever did, he said.Mascari also pointed to inconsistencies in information provided by Winchell and his attorney. When police interviewed him in an Arizona jail, Winchell denied knowing Murray or ever owning or driving a Firebird. he initially told police he took a bus to from New York to Tennessee. Rose said his client hadn’t denied anything, but had refrained from answering questions definitively and asked to see pictures of both Murray and the car, which Rose said the police investigators didn’t have. he called Mascari’s interpretation of that police interview a “complete distortion” of what happened.Calling the prosecution’s case circumstantial, Rose again told the jury that Mascari was asking them to piece together information that lacked physical and scientific evidence, a confession and eye witnesses. The basis of nearly the entire case is based on one piece of evidence – one phone call on Murray’s cell phone, Rose said.he argued that the prosecution failed to present any evidence to definitely prove, using cell phone records, that Murray was actually in Madison County May 22 or was with Winchell. According to Rose, cell phones can hit off cell towers up to 30 miles away and speculated that Murray could in fact have been in Syracuse when the call was made that bounced off a cell tower in Oneida.“I hope that it troubles you,” Rose said to the jury, that the only evidence to prove Murray was in Madison County is a single phone call. “There’s only one logical conclusion in this case and that is he’s not guilty of anything,” Rose said of his client.Calling the case “ a recipe for disaster,” he asked the jury to avoid unjustly accusing Murray of murder.In the end, the jury sided with the prosecution.

I did a lot of research before I chose this manufacturer. Chef’s Choice had the best rating for a home slicer.

Cons (?): I just unpacked it and read the instructions, which had typos (not a good start). the extra fuse fell on the floor because the bag was not sealed as it should have been (also not good: no seal in the bag, and why do I need one if it doesn’t overheat?). tried to register on line, no online registry (Hmm). Plastic square plate not listed in booklet (Guess what it’s used for?). Wanted to send an email to ask about the unlisted plastic square (assume it’s for catching slices), no email contact (What?), though you CAN call during business hours. CAN’T wash food-touching parts in the dishwasher, must be hand washed (Ugh). Comes with a serrated edge blade, and the reviews I read said that you really need a straight edge blade to cut thin slices well.

Pros: Construction is aluminum and stainless, as advertised. the only plastic is on the slider mechanism. Slicer mechanism moves smoothly. Seems to be well made. one year warranty. not too heavy (My old Rival model, also metal, was much heavier.) Storage compartment for plug.

Bigger (not sure if that’s a pro or a con) and better made (pro) than my old Rival.

Manual mentioned that foods with “uneven textures” should be “partially frozen” before cutting. Which leads me to question: can I use it successfully to cut cooked meats i.e. roast beef, turkey, ham. etc. without “partial freezing”? I want to use it to slice food for dining/party settings.

I’ll be back to update this review after using it for awhile. AND after contacting the manufacturer during business hours. LOL I’ll also find out if we can register our products on line SOMEWHERE.

Update: just used it to cut chilled roast beef.

I bought the non-serrated edge slicer blade (purchased separately) after reading the on-line reviews/recommendations. I like thin slices in my meat for sandwiches. it worked very well. the movement was smooth and almost effortless. the clean up was not bad at all. And I used the plastic square to “catch ” the meat. I lubricated with a silicone based lubricant, since no lubricant was suggested and I had it on hand. NOT good. the oil migrated to the first few slices of meat (yuck).

Just got off the phone with Edgecraft, the manufacturer. the blades need lubrication every time you replace them, i.e. after washing or when changing serrated to non-serrated, etc. you need to purchase “mineral based food grade Vaseline” from a restaurant type supplier. (Amazon carries it, but it’s VERY expensive through them. Read on. They gave me the name of Instawares.com Phone: 800-892-3622 Item #143-1063. I hazard to say that this lubricant is necessary no matter which food slicer you choose. I found a cheaper price for essentially the same product. I’m checking it out first before I recommend it. I couldn’t find the item number at the first site and they are quite expensive. I will update the info.

“Partial freezing” means “chilled” for best results, though you CAN cut freshly cooked meat after allowing it to sit for “20 minutes or so for an average sized roast.” DON’T cut frozen meat or meat with bones (I knew that).

You CANNOT register on line, though they might add it later, if enough customers, like me, complain. it HAS been requested in the past.

Update:the manual is REALLY bad. I gives you very little information. Got an email from the president of the company. new info from him: Chill ALL meats before cutting. the fuse is included for people who don’t read the manual and try to cut bones, frozen meats, etc. the slicer WILL overheat under those circumstances. the plastic tray IS for catching the meat (It says so “on the box.” I didn’t read the box. did you?)

BTW. if you’re like me, you will probably lose the fuse by the time you need it. I took a plastic zip bag, put the manual (such as it is) and the fuse inside, and taped it to the bottom of the unit. There is a recessed area underneath which is perfect for this. That way you won’t lose them.

Update:if you expect your thin slices to be as perfect as from the deli, I think you’ll be disappointed. Because YOU, essentially, are the power behind the pressure. if you put too much pressure into your slice it will be…

JOHNSTOWN – we may never know if the workers who constructed the building and steeple for Holy Trinity Church 150 years ago were drinking on the job.

But if it’s true, it appears they had a good time.

Workers excavating while building a new bathroom found about 100 beer, liquor and wine bottles and other artifacts, including a ceramic jug, in a pit beneath the foundation of the steeple, according to church Plant Manager Kevin Quinn.

The former St. Patrick’s Church, at the corner of Glebe and Clinton streets, was incorporated in 1865.

The Rev. Thomas Morette, Holy Trinity’s pastor, said the bottles and jug represent America from a more proud ethnic period, and the fact modern-day church workers found them is wonderful.

“It’s a nice human surprise,” Morette said. “It’s our own time capsule. I appreciate celebrating the different ethnic origins in Johnstown.”

The priest said the Holy Trinity Church building was built by Irish craftsmen. he said it is the oldest Catholic church building in Johnstown.

Quinn, who has begun to research some of the bottles, believes they are from about 1869. The bottles found are diverse, with glass-engraved labels bearing names such as “Thomas Behan Wholesale Liquors,” “Sautern Wine” and “Traveler’s Companion.” another bottle is from “R. Robinson., Atlantic Ave., Brooklyn.”

One of the bottles labeled “William Young Co.” from England probably once contained a pale ale, Quinn said.

“That type of ale was made for the [British] troops serving in India,” he said. “They have a lot of hops.”

Quinn explained that he was working with contractor Curtis Putman of Johnstown-based Putman Enterprises about two to three weeks ago on knocking out a section of the church foundation to install pipes for a new bathroom.

When the flooring and ground started to come up, Quinn said, contractors found an area where the bottles were found.

“It hadn’t been opened to the world since 1869,” Quinn said.

He said many of the bottles had been broken, but about 100 were unearthed intact, pulled out and saved. he said the bottles, which include bourbon bottles, are in “decent shape.” he said the bottles are now the church’s possessions and the church will see what it wants to do with them.

“I’d like to see them,” said city Historian Noel Levee, when told about the bottles. “I wonder if they were left by the [original church] workers?”

None of the bottles had any alcohol left in them. Quinn speculated the workers probably drank from them, then tossed them “into an area where they built the steeple.”

The bottles have now been placed gently in liquor and wine cases, because they have convenient cardboard flaps to preserve them. The bottles are in amazingly good shape after having been encapsulated for nearly 150 years.

“We want to eventually display them,” Quinn says.

Morette said if the bottles are worth money, they could be sold to help fund future church projects.

“They belong to the church now … if the church wishes to sell them or give them to a museum,” Quinn said.

Have you ever crossed the Border to shop? 

Yes, my dad drinks a dark rum that you can only get in Northern Ireland or in Britain so I bring him up to Banbridge to get it. He could go for free on the train, but it’s like a road trip for us, a chance for us to have a nice day together. Now and again, I’ll pick up something that’s cheaper, but generally there isn’t a huge difference anymore. the one thing that’s much cheaper is over-the-counter medicines, such as Calpol, Nurofen, etc.

Do you haggle over prices? 

If I’m in a situation where I can haggle, I always will try and get the best value I can.

Has the recession changed your spending habits? 

Yes, although I’m not a huge spender I have definitely cut back on buying clothes, going out for dinner, etc, but it’s more the two children in the creche that has changed my spending habits.

Do you invest in shares? 

No, I never have, although I sometimes wish I had, but, as my mother says, “hindsight is a wonderful thing”.

Cash or card? 

Always card – I hardly ever have cash. I don’t like having change on me as the temptation to go to the vending machine in work is too much.

What was the last thing you bought and was it good value for money? 

I just bought some St Patrick’s Day accessories for my nieces and nephew in the US in Dunnes and it was great value for money as they’ll be thrilled and I think the total was €13.50 for nine items.

Have you ever successfully saved up for a relatively big purchase? 

My husband Steve and I saved for the deposit on our first house and as I said already, my car.

Have you ever lost money? 

We have lost a lot of money on our house in Wicklow and I lost the €1 I had in my tracksuit bottoms that I put in the wash yesterday.

Are you a gambler and if so have you ever had a big win? 

Does donkey derby in Star Amusements in Bray count as being a gambler? I did play the slot machine there about 12 years ago and I put in £1 and hit the jackpot and ended up with £110! Vegas here I come.

Is money important to you? 

Well, it would help to have money because life would be comfortable, but I have my health and my family and when you get a health scare, money seems so unimportant. We are lucky to have our jobs and we get by. We try to do as many things as possible with the kids that don’t cost money, but it’s very hard in this country when it’s raining. Everything seems to cost money.

Best money saving tip you’ve ever heard? 

Let your dad get it.

How much money do you have on you now? 

A €10 note which I don’t want to break as I’m in work until midnight and if I had change on me, I’d be down at the vending machine.

IT IS ”back to school” time – the supermarkets are full of stationery, the shoe departments full of kids and glossy magazines full of ideas for school lunches.

Last week, I found an article on creative ideas for kids’ lunches that left me wanting to throw that classic heckler’s tool, the rotten tomato.

Don’t get me wrong, the sandwiches in the photos were indeed creative. But they were clearly freshly made for the photo and had never been near a layer of cling wrap or inside an actual lunch box.

Despite fillings including tomato or mayonnaise or mustard – or all three – none of the sandwiches was soggy or flat, which is what they’d be if they’d been made at 8am and jiggled around in a school bag until 1pm.

I’ve been making school lunches for eight years now, so I know a thing or two. I can’t help feeling these annual school lunches articles are beamed from a parallel universe.

Why can’t they show us the sandwiches as they’d look when the lunch box has been tossed or sat on, or the sandwich has been dropped in the playground and acquired an encrusting layer of dirt, or after it’s sucked moisture like a sponge from the frozen drink thawing next to it? Images of what they’d actually look like to the kid who is about to attempt to consume them? if anyone can suggest how a tomato sandwich will look or taste good four or five hours after it was made, I’d be glad to hear it.

School lunches are a sensitive subject. after asking adult friends and work colleagues about their childhood experience of school lunches, I found deep psychological scars.

A neighbour remembered her mum making her lunches for the week and freezing them, getting new ones out each day for school. Friday’s lunches were soggy and awful. another friend told how he binned his lunches, and had never eaten school lunches until he could make them for himself.

My personal psychological scar relates to rock cakes – for recess every day, dry and completely tasteless. I hated them and haven’t eaten one since. And yet, I may also be an inflicter of psychological school lunch damage.

A few years ago, we found that one of our children had been stashing uneaten school lunches under a sofa for most of the term. It was only with an infestation of fruit flies we realised something was amiss. A lot of soul-searching about our parenting followed. not wanting to foist unwanted sandwiches on my offspring and hoping to heal any damage, I asked for preferences for sandwich fillings. The answer? Tomato.

When I began research for our month of Black breastfeeding history I was disappointed by what little information I could find. When I look up Black+breastfeeding+history I get nothing but articles after articles about Black women as wet-nurses.

A wet-nurse is a woman who breastfeeds and often cares for another’s child. Wet-nursed children may be known as “milk-siblings”, and in some cultures the families are linked by a special relationship of milk kinship. Wet nurses are solicited for many reason and used in many societies and cultures throughout history. Unfortunately, Black women have been the ones to become the poster child of the “profession” due to the impact of slavery and institution of wet-nursing and care-giving of their slave owner’s children.

So when I began my research for this month all I could find was this:

So, I’m thinking “I know, I know. It’s Black history month; why we gotta talk about slavery?! I so do NOT want to talk about slavery.” It wasn’t until I stumbled across the amazing blog, Mommy too! Magazine: Celebrating Black Mothers and Motherhood, that I was hipped to some very interesting history about “sucklers,” or breastfeeding slaves, that I had never heard before.

According to the book American Negro Slavery: A Survey of the Supply, Employment and Control of Negro Labor as determined by the Plantation Régime by Ulrich Bonnell Phillips, in some circumstances breastfeeding slave were afforded some  ”privileges” (for lack of better words) in order to provide breastmilk for their children.

Sucklers are not required to leave their homes until sunrise when they leave their children at the children’s house before going to field. The period of suckling is twelve months. Their work lies always within half a mile of the quarter. They are required to be cool before commencing to suckle to wait fifteen minutes at least in summer after reaching the children’s house before nursing. It is the duty of the nurse to see that none are heated when nursing as well as of the overseer and his wife occasionally to do so.

They are allowed forty-five minutes at each nursing to be with their children. They return three times a day until their children are eight months old in the middle of the forenoon at noon and in the middle of the afternoon till the twelfth month but twice a day missing at noon during the twelfth month at noon only. The amount of work done by a suckler is about three fifths of that done by a full hand a little increased toward the last. Pregnant women at five months are put in the sucklers gang. No plowing or lifting must be required of them. Sucklers old infirm and pregnant receive the same allowances as full work hands.

BATAVIA — Hors d’oeuvres, scrumptious desserts, a talented trioof musicians and a basket raffle are on tap for the second annualCabaret, organizers say.

Local performers Jon Seiger, a trumpet player revered for hisspot-on resemblance to Louis Armstrong, and former Broadway actressBev Miner will perform a series of variety acts from 7 to 10 p.m.Saturday at St. James Church, 405 East Main St. It’s a benefit forthe church’s Restoration Fund and for Community Action of Orleans& Genesee.

“We decided to do something a little different this year. It’s justgoing to be a fun, comfortable evening,” Community Action EmergencyServices Coordinator Lisa Wittmeyer said. “I think the comedy isgoing to be fun. they are entertaining. I hope people will singalong.”

The pair’s entertainment will be interspersed with Batavia HighSchool senior Melzie Case on piano. Her line-up so far includesBilly Joel’s “Nocturne,” “River Flows in You” and “To a WildRose.”

Miner, who lives in Stafford and performs regularly with Seiger,promised a “floor show” with the works. The duo will sing, playinstruments — he plays keyboards and trumpet and she’s a drummer —tell jokes and even dance. Miner also plans to incorporate herchildhood days of taking lessons on Waikiki Beach and do anauthentic hula.

“If they want straight music they can turn on the radio,” shesaid.

Not short on experience, Miner spoke of her early life, growing upas an Air Force “brat” and living in Hawaii, England and Colorado,to name a few. she sang and danced on Broadway years ago when shemet Frankie Nan, a popular tenor sax player from Rochester. Thatrelationship brought her to Western new York and, after Nan died,she eventually met and married the late Ken Miner and moved toStafford.

Now she keeps busy performing with Seiger, a former piano man forTony Bennett, at area nursing homes, night clubs and just recentlybooked Lakeside Memorial Hospital to entertain patients. there arestories to tell in between the music, along with perhaps a bit ofschtick. 

“I put Vaseline on my hair and my mind keeps slipping,” she said.Ba-dum-dum.

Meanwhile, the event will include grazing stations with bruschetta,mini crustless quiche and pigs in a blanket, plus, due to populardemand, the return of St. James member Chip McGuire’s “famous”rosey deviled eggs. A new feature this year is a hot dipping barwith Reuben, chicken wing and artichoke dips.

For the sweet tooth, there will be a chocolate fountain accompaniedby fruit, pound cake and Oreo cookies; tiramisu and cheese cakesand chocolate puddles, which are cupcakes filled with a decadentganache. there will be a mix of items made in the St. James kitchenand donated from community vendors. all of this will becomplemented by Pavilion Girls Service League serving horsd’oeuvres, tables full of gift baskets up for bid and wine, serveduntil 9 p.m.

Some of the auction items include a three-month membership to YMCA,a gift certificate of wine and chocolate tasting at Leonard OakesEstate Winery, a Schwinn bicycle and a Mardi Gras basket with“typical new Orleans teats” such as a handmade table runner, partyplates, jambalaya mix, and a colorfully frosted king cake featuringa traditional plastic baby Jesus inside.
